Q: In my divorce decree, it is stipulated that my ex-husband must pay off a credit card which is under my name. For the last six months, he has not fulfilled any monthly obligations on those payments. This has incurred large late payment fees and more importantly hurt my credit score. How can I get this card put in his name to affect his own negligence?
A: Your divorce decree is an agreement between you and your spouse. It doesn’t erase the contract you have with the creditor, which requires you to pay off that account that is in your name. You are going to be stuck with the balance and the bad credit unless you can work something out with the creditor. Talk with your attorney.
